:Metrolinx is connecting communities across the Greater Golden Horseshoe. Metrolinx operates GO Transit and UP Express, as well as the PRESTO fare payment system. We are also building new and improved rapid transit, including GO Expansion, Light Rail Transit routes, and major expansions to Toronto\'s subway system, to get people where they need to go, better, faster and easier. Our Commercial Management Office is seeking a Manager, Commercial Management to provide guidance and management of commercial decision-making and promotion of coordination of commercial leadership for Rapid Transit. The incumbent will provide advice to the Senior Manager and Director of Commercial Management, and other Metrolinx senior leaders and partners.   • Develops and implements strategies, methodologies, tools and techniques for commercial management excellence and continuous improvement
  • Assists in the development and implementation of contract management systems, standards and operational procedures to ensure successful delivery of the organization\'s large and complex operational initiatives.
  • Analyzes and provides recommendations on procurement strategies consistent with overall strategic goals of the Division.
  • Monitors contract performance management through pro-active issue resolution, change requests/amendments, and standardized internal processes that contribute to achievement of desired service levels and Key Performance Indicators (KPIs).
  • Provides guidance and leadership in the development of contract negotiation, governance and management strategies to ensure that Metrolinx effectively negotiates contracts that adhere to Metrolinx policies and procedures, and to minimize corporate liability and risk throughout the contract lifecycle. Identifies and closely monitors contractual risks, constraints and contingencies to avoid or mitigate additional costs, penalties and delays. Supports the development of, and directly implements, mitigation tactics throughout the contract lifecycle.
  • Produces contract performance reports and maintains monthly, quarterly and executive management reports and distributes as needed.
  • Actively anticipates changes in both external and internal environment for potential impacts and risks and takes appropriate action to inform and mitigate risks.
  • Authors and assists in the review and analysis of the Division\'s highly complex tenders and contract documents to ensure that the appropriate contracting strategy and contractual clauses are applied to reduce risk and protect the interests of Metrolinx.
  • Provides input into complex contractual claims and may lead the management, analysis and resolution of disputes
  • Identifies, analyzes and develops responses to commercial risks, and reports on contract performance.
  • Develops risk mitigation strategies to ensure the compliance of contracts and change orders with Metrolinx policies and procedures and to minimize corporate liability.
  • Manages aspects of contract administration including consultative advice, expertise and support to project teams throughout the life of operations projects.
  • Works with Finance to establish and maintain financial control systems and ensures timely flow of documents required by the Contract Administration and Finance teams.
What Skills and Qualifications Do I Need?
  • Completion of a degree in, Engineering, Contract/Construction Law, Business Finance, Supply Chain Management or a related discipline or a combination of education, training and experience deemed equivalent.
  • Demonstrated experience in progressively responsible roles related to the planning, design, construction and operation of rail and/or transit infrastructure and services, and related works including at least 4 years of experience managing large, complex, multi-year transit projects and/or operational contracts.
  • Project Management Professional (PMP), Supply Chain certification (cSCMP, CIPs) designation would be an asset.
  • Expert knowledge of contract administration and claims management techniques and practices in a large multi project complex operational, construction and infrastructure environments.
  • Experience with various procurement methods, both traditional and non-traditional (especially AFP - Alternate Financing Procurement).
  • Extensive experience in the interpretation of contract law, and Ontario legislation
  • Proficient experience in using contract administration systems, such as Primavera Contract Manager, Oracle Unifier, Ariba, Coupa, etc.
  • Management and leadership skills to manage departmental staff and lead projects and motivate a team of Senior Contract Administrators, matrixed staff and consultants.
  • Excellent communication skills, written and verbal and a positive attitude to drive resolutions to stakeholder issues.
