The Position
The successful candidate will:
Provide legal opinions on policy, agreements, legislation and various areas of law including labour and employment, administrative, contractual relations, human rights, constitutional, and privacy.
Conduct legal research
Conduct negotiations where required as counsel for the Commission
Advise Mediators, Investigators on matters concerning resolution of complaints
Prepare briefing notes
Prepare written policy and procedure documents where required
Prepare and responds to Access to Information requests
Make recommendations regarding amendments to human rights legislation as requested.
Maintain current knowledge of case law and other developments in the field of human rights in Canada and elsewhere.
Draft dismissal or deferral decisions for the Chief Commissioner
Draft decisions relating to requests to extend the limitation period pursuant to The Saskatchewan Human Rights Code, 2018
Respond to requests for summary dismissal and deferral for the Director of Resolution
Assists with disclosure preparation, written applications, briefs of law and argument, factums, and all associated court documents
May sit as second chair in the litigation process
Use problem-solving, mediation, conciliation, and collaboration as dispute resolution methodologies.
Participate in negotiations with parties or legal counsel that may be undertaken in an attempt to resolve complaints.
Prepare agreements on settlement or any other matter as requested.
Prepare and deliver public presentations as requested.
Prepare and deliver staff training sessions.
Using the Commission electronic filing system, record action, and report activities in a timely manner
Essential Education, Skills, and Experience
The successful candidate will:
be energetic and confident with superior analytical, problem-solving and communication skills;
demonstrate competence in dispute resolution skills including mediation and negotiation;
have experience assessing risk, evaluating the strengths and weaknesses of legal disputes;
have courtroom experience, including trial advocacy;
be qualified for membership in the Law Society of Saskatchewan, having a minimum of
3
years of experience in active legal practice, including collaborative resolution and human rights law, or equivalent.
have a demonstrated knowledge and understanding of The Saskatchewan Human Rights Code and Regulations, the Canadian Charter of Rights and Freedoms, constitutional law, administrative law, labour law, and employment law.
Compensation
The compensatory rate range for this position is $46.60 to $74.27 per hour, in addition to usual benefits.
