The Litigation and Bodily Injury claims advisor is responsible for handling bodily injury liability claims from within QC and the USA. This is a role that includes in-depth investigations regarding liability/responsibility and the amounts associated with the claims. The successful candidate must regularly deal with the plaintiff and the defense lawyer and travel may be necessary. Responsiblities include but are not limited to the following:
  • Investigate, promptly and thoroughly, with respect to civil liability, injuries and other damages related to the claim (bodily injury in Qc as well as automobile accidents outside of Qc), by conducting and leading the investigation to a logical conclusion. Investigations can be done jointly with an independent claims adjuster as reviewer.
  • Establish and maintain sufficient reserves by following the protocol and practices for establishing reserves for bodily injury; follow all established protocols regarding the identification, notification and reporting of Major Claims; adhere to all established protocols regarding claims authorizations.
  • Collect and document claim-related information in a clear and concise manner, while adhering to established protocols to ensure accuracy and quality of information.
  • Establish and maintain a proactive and solid management of contentious compensation files, respecting the established guidelines.
  • Manage potential allowances and expenses to ensure sound cost management principles and practices.
  • Exercise sound judgment in evaluating and resolving all legally valid claims, considering all available information and adhering to established guidelines.
  • Communicate promptly with all claimants to establish and maintain a relationship of trust and collaboration to resolve claims within a reasonable time and through a fair and proactive process.
  • Manage claimant expectations throughout the claims process, by regularly monitoring and delivering on commitments to resolve claims quickly and fairly.
  • Communicate with all parties, including legal experts, regarding their role, rights and responsibilities in the compensation process, in order to obtain and maintain their cooperation.
  • Build trust and establish business relationships with plaintiffs\xe2\x80\x99 attorneys to enable timely, fair and professional settlements through good communication.
  • Proactively manage and collaborate with defense counsel, according to established management practices.
  • Complete all necessary reports within a reasonable time frame.
  • Attend settlement meetings, mediation sessions and trials outside of the office.
  • The incumbent may be required to work irregular hours to schedule activities based on the availability of key people or events.
Requirements
  • Minimum 5 years of experience as a claims adjuster, experience in Personal Injury OR related experience in litigation, an asset.
  • Knowledge/experience of current Rules of Civil Procedure.
  • Thorough understanding of the insurance industry and related legal environment.
  • Ability to prioritize and perform all claims processing related activities based on availability and accessibility of clients, third party claimants, witnesses, medical professionals, peace officers and forensic experts, as needed.
  • Strong interpersonal skills and superior communication skills.
  • Ability to deliver on a customer service-oriented approach.
  • Excellent organizational and time management skills.
  • Effective analytical skills and attention to detail.

Additional Information
In order to be considered for this role, a successful candidate must:
  • be bilingual; (advanced language skills in French/English are required)
  • be the holder of a valid claims adjuster license recognized by the Autorit\xc3\xa9 des march\xc3\xa9s financiers (AMF)
