Job Description


The Legal Counsel, Operations, develops and maintains strategic policies and standard procurement documents under the direction of the General Counsel and Corporate Secretary. The incumbent provides expert guidance and advice on legal matters arising in all DCC service lines, and analyzes, interprets and implements complex legal policy and law reform proposals. Supporting the General Counsel and Corporate Secretary, the incumbent applies relevant knowledge (e.g. legal principles, procedures, the substantive law and possible options), skills and attributes to each matter, developing and advising an appropriate course of action, and implementing and communicating decisions taken by the Corporation. The Legal Counsel, Operations, interprets legislation and regulations, drafts contracts, clauses, policies, leases and other related documents, and conducts research and studies, as needed. The incumbent develops and maintains relationships with internal and external stakeholders and exerts national influence in the area of procurement.KEY AND PERIODIC ACTIVITIES
The duties and responsibilities listed below are representative but not all-inclusive:
Primary

  • Provide legal counsel for key strategic initiatives related to Client-Partner procurement
  • Provide legal counsel to all service lines in other areas, such as anti-corruption and fraud mitigation
  • Manage risk in the procurement process
  • Develop and maintain solicitation and contract documents to support contract services delivery
  • Carry out research for unique procurement requirements
  • Develop innovative procurement procedures, including those for unique requirements
  • Develop and maintain strategic policies
  • Develop, lead and manage strategic corporate initiatives related to procurement
  • Maintain the fraud detection and prevention program
  • Produce effective internal and external reports, analyze data and make recommendations to support the General Counsel and Corporate Secretary
  • Develop and maintain effective relationships within DCC, and with industry, other government organizations and/or stakeholders
Other
  • Participate in external committees and meetings related to procurement policy (e.g. Treasury Board of Canada Secretariat committees, meetings with Global Affairs Canada related to trade agreements, industry committees)
  • Other duties as assigned
SKILLS
General and Specific Knowledge
  • Best practices, methods, trends and legislation in procurement, competitive bidding, contract law (as they apply to all DCC service areas, including construction) and trade agreements
  • Best practices in the construction industry
  • Government policies, trade agreements and external reporting requirements
  • Procurement risk management principles
Formal Education and/or Certification(s) and Experience
  • Minimum: university degree in law (JD, LLB, BCL or LLL) with eight or more years\xe2\x80\x99 relevant experience in procurement of construction-related services, including providing related legal counsel; membership in good standing in a provincial or territorial law society
Abilities
  • Use applicable computer software and operating systems
  • Possess strong research, analytical and contract writing skills
  • Be bilingual (English and French); mandatory
  • Manage multiple deadlines and priorities
  • Demonstrate attention to detail
  • Resolve complex problems with multiple stakeholders
  • Apply risk management techniques
