Current and prospective clients include all levels of governmental and regulatory agencies, and provincial, national, and international professional bodies. The Division is a revenue generating unit that is self-funded. As such, success depends upon maintaining a national reputation as a quick response provider of leading edge, award-winning programs.The Legal Associate, Licensing Education position (the \xe2\x80\x9cPosition\xe2\x80\x9d), which reports to the Executive Director of the Division, under the general direction of the Division\xe2\x80\x99s Directors, is responsible for establishing comprehensive plans (including curriculum plans), policies, and strategies to support the Division\xe2\x80\x99s overall strategic plan of strengthening relationships with current clients and expanding across other provinces and/or nationwide. Such work must consider (1) legal developments in the real estate industry; (2) educational best practices, including innovative delivery strategies; (3) the applicable real estate regulatory environment; and (4) internal budgetary constraints.In particular, the Position is responsible for the extensive development and delivery of the Division\xe2\x80\x99s education programs, which include pre-licensing and mandatory post-licensing real education programs across multiple provinces/territories, and voluntary continuing real estate education programs nationwide. As one of the Division\xe2\x80\x99s legal content subject matter experts, the Position is responsible for the creation of a wide variety of legal materials covering a diverse range of topics, (e.g., real estate sales, mortgage brokerage, property management, etc.) with applicability in a number of different provinces (e.g., British Columbia, Saskatchewan, Alberta) which need to reflect their respective and unique legislation. Furthermore, the Position is responsible for all legal aspects involved in developing policies, systems and organizational practices related to the Division\xe2\x80\x99s education and examination operations.May require some travel within and outside Canada.Organizational Status
Reports to the Executive Director of the Division and works with internal and external subject matter experts, Allard School of Law graduate student academic assistants, and legal counsel, as well as various full- and part-time staff involved in academic operations, course and examination production and delivery, and information technology.Work PerformedLegal Content and Examination Development - The Position is responsible for maintaining the legal academic integrity of the Division\xe2\x80\x99s course materials and examinations. Responsibilities include leading ongoing evaluation to identify new and existing curricular requirements; thoroughly researching and writing highly technical legal materials across a broad variety of topics such as land law, contract law, agency law, tax law, and mortgage law, based on the thorough knowledge of legislation in different provinces; maintaining a network of subject matter experts in the area of real estate; negotiating contracts with and engaging external legal counsel and other subject matter experts to assist in the creation of legal materials; creating examination content and adjusting such content in response to psychometric analyses; and managing and supporting summer and part-time Allard School of Law graduate student academic assistants (i.e., law tutors) in the development of legal content and examination item creation.Project Management - Course and Examination Development and Delivery - The Position includes a significant project management function and is responsible for the development of comprehensive plans, policies, and innovative delivery strategies for courses and examinations to support the Division\xe2\x80\x99s overall strategic plan of strengthening relationships with current clients and expanding across other provinces and/or nationwide. Such work considers content development, learning outcomes, delivery strategies, analysis of the market, budgets, participants/learners, prices, digital marketing, registration information, accreditation, and video production, and balances the need for customer-focused student services; academic and regulatory integrity; educational best practices; the regulatory environment; program security; and financial viability.Responsibilities include researching and staying informed about educational and regulatory best practices; liaising with key regulatory body and professional association contacts; developing new and redesigning existing programs to meet the needs of new and existing clients, within internal budgetary constraints; collaborating with instructional support units and curriculum developers to facilitate the delivery of the Division\xe2\x80\x99s programs; evaluating education technology for its appropriateness for the Division\xe2\x80\x99s programs; developing instructional plans for lectures; conducting extensive, sophisticated, and comprehensive (academic, market research, financial, etc.) reviews and research to identify potential educational programming opportunities; and developing marketing plans and promotional strategies.Legal Support \xe2\x80\x93 The Position is responsible for all legal aspects involved in developing policies, systems and organizational practices related to the Division\xe2\x80\x99s education and examination operations, and provides legal support to the Division\xe2\x80\x99s Directors on a variety of legal matters, including contract negotiation, drafting, and review; the creation and maintenance of course and program regulations; student discipline; compliance with legal requirements such as the Freedom of Information and Protection of Privacy Act, Canada\xe2\x80\x99s Anti-Spam Legislation, and intellectual property law. To do this, the Position may liaise with the University\xe2\x80\x99s Office of the University Counsel.Consequence of Error/Judgement
The Position makes decisions regarding the Division\xe2\x80\x99s program administration, including curriculum designs/planning, program policies, and innovative program delivery strategies, which are all expected to align with the Division\xe2\x80\x99s overall strategy and internal budgetary constraints. As such, decisions in this area have both immediate and long-term impacts on the operating results of the Division. Inadequate judgment or decision-making would have significant and possibly permanent negative effects on the Division\xe2\x80\x99s, Faculty\xe2\x80\x99s, and the University\xe2\x80\x99s reputation and may result in the loss of economic opportunities and of profitability. Many decisions involved in the Position have a direct impact on the Divisions\xe2\x80\x99 students\xe2\x80\x99 ability to meet academic and professional licensing requirements, and ultimately on their ability to become active members of the real estate industry.Supervision Received
The Position works under broad directives set by the Division\xe2\x80\x99s Directors, and is expected to exhibit considerable autonomy in pursuing the strategic vision and objectives of the Division. Work is reviewed with respect to adherence to broad policies and progress towards strategic goals. The Position consults with the Division\xe2\x80\x99s Directors for direction, input, and advice on course development, strategy, financial matters, and policy issues.Supervision Given
Responsible for recruiting, engaging, and managing (1) both internal and external subject matter experts, instructors, editors, and legal counsel in multiple provinces, and (2) summer and part-time Allard School of Law graduate student academic assistants. Responsible for overseeing the workflow of various full- and part-time staff involved in academic operations, course and examination production and delivery, and information technology.Minimum Qualifications
Master\xe2\x80\x99s degree in Education with a specialization in curriculum development or an academic specialization relevant to the educational programming area. Minimum of eight years of related experience, or the equivalent combination of education and experience.- Willingness to respect diverse perspectives, including perspectives in conflict with one\xe2\x80\x99s own
- Demonstrates a commitment to enhancing one\xe2\x80\x99s own awareness, knowledge, and skills related to equity, diversity, and inclusionPreferred QualificationsLaw degree LL.B./J.D. and private practice experience is required, along with eligibility for membership in the Law Society of British Columbia. Experience as a either a solicitor or litigator in the areas of real estate or corporate law is preferred. Education experience is an asset but not essential.An in-depth knowledge of the legal and regulatory framework of the real estate industry in Canada and abroad is required.Exceptionally strong written and oral communication and interpersonal skills and a demonstrated ability to operate strategically in a complex competitive environment are required.Ability to simultaneously manage a diverse range of complex projects and activities with staff from a variety of functional areas is required.Ability to travel within and outside Canada.
