Law Clerk, Professional Conduct Unit

The Ontario College of Teachers is seeking an experienced legal professional with meticulous attention to detail and accuracy to provide legal and administrative support to a team of lawyers at one of Canada's largest professional regulators. Membership in good standing with the Law Society of Ontario is required for this position. Reporting to the Manager, Professional Conduct, the successful candidate will be responsible for facilitating Complaint Resolution proceedings and providing litigation support to College Counsel in proceedings before the College's Discipline Committee and Fitness to Practise Committee.

Responsibilities:

Prosecution Duties:

Draft pleadings and other legal documents, such as Notices of Hearing, Notices of Referral, Agreed Statements of Facts, Statements of Uncontested Facts, Joint Submissions on Penalty, Affidavits, Disclosure Briefs, and Books of Authority. Assist counsel in preparing for examinations, pre-hearing conferences, and hearings, including by communicating with the Tribunals' Office, witnesses, counsel, and others as necessary. Conduct legal research as required. Coordinate redaction, service and filing of hearing documents. Gather, assess, and catalogue evidence obtained during College investigations for utilization/production/disclosure in legal proceedings. Review Discipline or Fitness to Practise referrals for assignment to counsel. Attend hearings to support prosecutors as required.

Complaint Resolution Duties:

Draft legal documents, such as Memoranda Proposing Resolution, Memoranda of Agreement, Requests for Adoption and Draft Decisions. Conduct research on case law/precedents. Update hearings and Complaint Resolution tracking data on electronic tracking systems. Liaise with members/members' counsel as required. Attend Complaint Resolution panels to support Complaint Resolution Officers.

General Unit Support

Conduct legal research into ad hoc issues as they arise, assist counsel with same. Attend and participate in professional development, workshops and training sessions. Assist with Unit projects such as template, policy and procedure reviews, KPI development and implementation, coordinating translation of materials. Perform other duties as assigned by the Manager, Professional Conduct and/or the Director, Investigations and Professional Conduct.

Qualifications, Skills & Experience:

Membership in good standing with the Law Society of Ontario is required for this position. Knowledge of legal procedures and format, relevant legislation, rules, court and tribunal administration practices. Experience in preparation of legal documents. Proven/demonstrated research skills to locate and analyze relevant case law, citations, and applicable statutes for inclusion in legal documents College diploma or university degree, or equivalent, with progress toward, or completion of Law Clerk or Paralegal diploma program(s). Ability to determine appropriate legal outcomes. Excellent written and oral communication skills Proven ability to work under pressure and handle competing tasks and deadlines. Results oriented: Ability to work with others, contribute to a collaborative and positive work environment, and demonstrate flexibility in balancing multiple projects. Strong attention to detail and accuracy. Ability to work on cases of a sensitive and sometimes-disturbing nature related to the abuse of children and/or criminal conduct. Computer skills: Microsoft Office including Word, Excel, PowerPoint; familiarity with web-based applications and online video meeting software an asset. Bilingualism (English-French) an asset.
