About the Firm:



Heer Law specializes in providing intellectual property law, intellectual property litigation, patent agent and trademark agent services. We are an ambitious and growing boutique intellectual property law firm located in downtown Toronto.

We specialize in representing direct clients, most of whom are in Canada and the United States, as opposed to foreign associate work.

The Opportunity:



We are seeking a self-motivated, results-driven IP/IP litigation associate with 2+ years of post-call experience. The ideal candidate is interested and capable of working in both contentious and non-contentious matters in the areas of patent, trademark, copyright, industrial design and trade secret and confidential information as the split between contentious and non-contentious work in this position is about 60/40.

While you will regularly work with the firm's partners and other lawyers at the firm, you will also have considerable direct client contact and management of client matters. This role is especially suited to a lawyer who considers him or herself entrepreneurial and who truly enjoys the relationship-building aspects of the practice. In particular, the position will provide the successful candidate with a great opportunity to continue their professional growth.

Your Responsibilities May Include:



Preparing and responding to cease and desist letters Negotiating settlements Preparing court, arbitration and mediation documents Appearances in court, arbitration and mediation proceedings Documentary productions and oral examinations for discovery Working with experts in the litigation process Providing advice on intellectual property matters Preparing draft patent, trademark and design applications, and associated office action reports and responses Preparing patentability assessments Preparing infringement and validity opinions Preparing intellectual property related agreements Conducting in-person and phone consultations regarding intellectual property issues Supervising and training articling and summer students Involvement in the firm's sales and marketing activities

Qualifications:



Licence to practice law in Ontario 2+ years of pre- and/or post-call private practice experience in intellectual property and/or intellectual property litigation The ability to work independently The ability to help supervise and train articling and summer students The ability to work harmoniously with the entire team Excellent written and oral communications Proven client management skills, including an aptitude for maintaining and growing client relationships, developing new client business and providing exemplary client service Registration as a trademark agent and/or a patent agent is not essential but would be an asset A technical background in engineering or science would be an asset
Compensation includes a base salary with the availability of bonuses. Bonuses are based on financial performance, client satisfaction and contribution to firm-building activities.
