OMVIC is currently searching for an Investigator for the North Toronto, Barrie Area Who is OMVIC? OMVIC (Ontario Motor Vehicle Industry Council) is Ontario\xe2\x80\x99s vehicle sales regulator. OMVIC enforces the Motor Vehicle Dealers Act and other consumer protection statutes for the Ministry of Public and Business Service Delivery. OMVIC\xe2\x80\x99s mandate and role is to maintain a fair and informed marketplace by protecting the rights of consumers, enhancing industry professionalism, and ensuring fair, honest, and open competition for registered motor vehicle dealers. This is achieved by maintaining strict dealer/salesperson registration requirements; inspecting all Ontario dealers (new and used); providing free complaint handling to consumers; developing/delivering consumer and dealer education/awareness programs; and investigating and prosecuting industry non-compliance and illegal sales (curbsiding). Position Summary: The Investigator is responsible for conducting investigations on behalf of OMVIC. OMVIC Investigators are appointed under the authority of the Motor Vehicle Dealers Act, 2002 and are designated Provincial Offences Officers under the Provincial Offences Act. OMVIC Investigators report to the Manager, Investigations and work both independently and within a team environment to investigate a wide range of issues involving unregistered activity (curbsiders) or industry misconduct. Investigations are initiated as a result of information received from various sources, including referrals from OMVIC staff, consumers, police, registrants, and trade associations. If substantiated, complaints against a registrant can result in referral to the Discipline Committee, prosecution in Provincial Offences Court and/or issuance of a Proposal to Revoke or Suspend Registration. Curbsider enforcement is conducted through POA prosecution. This Investigator position is a home-based office with North Toronto, Barrie as the geographical area of responsibility. Responsibilities: \xc2\xb7 Review files and gather necessary information to identify relevant issues \xc2\xb7 In consultation with Manager, identify cases where formal investigation is necessary and appropriate \xc2\xb7 Conduct thorough and objective investigations, involving both individual and industry issues with a focus on rigorous fact-finding, fairness, timelines, and attention to detail \xc2\xb7 Plan and conduct thorough interviews using a variety of interviewing techniques and record statements using electronic recording equipment \xc2\xb7 Identify, obtain, and review and analyze all documentation (e.g., legal contracts, accounting records, computer records, legal reports, etc.,) relevant to the investigation \xc2\xb7 Review and analyze all evidence collected during an investigation, including identification and analysis of any legal/regulatory issues \xc2\xb7 Write detailed, high quality reports and correspondence setting out facts of a case cogently, objectively, and accurately and in appropriate detail, followed by a well reasoned analysis and objective assessment of the evidence, maintains appropriate investigative notes \xc2\xb7 Recommend appropriate steps to take following analysis of the evidence including proposed findings and recommendations \xc2\xb7 Write and/or assist in the preparation of court documents (including briefs, witness statements, exhibits, etc.), search warrants, etc. \xc2\xb7 Lead or participate as a team member on complex investigations from inception to completion, ensuring investigation is completed thoroughly and on time \xc2\xb7 Manage assigned files in accordance with organizational standards including meeting established timelines and deadlines \xc2\xb7 Establish good working relationships with all stakeholders including complainants, officials and others \xc2\xb7 Share relevant information with other investigators, inspectors, legal staff \xc2\xb7 Maintain and close files in accordance with organizational standards \xc2\xb7 Exercise independent judgment with limited direction and is accountable for decisions \xc2\xb7 Consult with Manager and/or Legal Counsel for guidance where appropriate \xc2\xb7 Assist Registration, Complaints, Compliance Teams with issues, providing assistance/information as required \xc2\xb7 Execute and serve search warrants, summons, subpoenas, notices, orders, as required \xc2\xb7 Establish and maintain liaison with law enforcement/government agencies \xc2\xb7 Appear as witness at various legal proceedings/hearings \xc2\xb7 Maintain awareness of relevant legislation and latest developments in investigative techniques \xc2\xb7 Other duties related to investigations as required Qualifications: \xc2\xb7 University degree in a field related to one or more of the following: law, social science, political science, psychology or public administration or an equivalent combination of education, training and experience \xc2\xb7 Formal training in advanced investigative/enforcement strategies/techniques is considered an asset \xc2\xb7 Considerable and recent investigative and enforcement experience in similar law enforcement and/or regulatory environment \xc2\xb7 Demonstrated, acceptable experience in the investigation of complex fraud cases \xc2\xb7 Demonstrated experience preparing high quality detailed investigative notes/reports dealing with individual and industry issues and including identifying and applying relevant legislation \xc2\xb7 Strong analytical skills and the ability to assess relevant evidence and exercise sound judgment impartially and objectively \xc2\xb7 Knowledge of the Criminal Code, the Canada Evidence Act, the Motor Vehicle Dealers Act 2002, the Consumer Protection Act, and the Provincial Offences Act. \xc2\xb7 Working knowledge of the Ontario Motor Vehicle Industry Council, as well as provincial government organizations, boards, and agencies relevant to the automotive industry \xc2\xb7 Knowledge and understanding of accounting principles and practices and familiarity with auditing concepts and procedures \xc2\xb7 Well developed research skills \xc2\xb7 Demonstrated commitment to customer service and quality principles in service delivery and application of administrative fairness \xc2\xb7 Demonstrated understanding of issues affecting consumer protection \xc2\xb7 Strong interpersonal skills, including the ability to deal with challenging situations and to deal with vulnerable complainants \xc2\xb7 Excellent organizational, administrative and time management skills \xc2\xb7 Excellent interpersonal skills to maintain ongoing liaison with industry, law enforcement and government officials at all levels \xc2\xb7 Demonstrated ability to work independently and in a team environment \xc2\xb7 Able to use personal computers for the entry, manipulation and retrieval of data and the preparation of reports, correspondence and communications \xc2\xb7 Valid Class \xe2\x80\x98G\xe2\x80\x99 Ontario Driver\'s license \xc2\xb7 Must reside within the geographical area of responsibility or willing to relocate \xc2\xb7 Must be able and willing to travel throughout
