What you\xe2\x80\x99ll be doing Reporting to the Chief Officer, Strategy, Governance and Reconciliation, the Corporate Legal Counsel (CLC) works to ensure the effective, efficient, and fair management of all legal matters within the purview of the College in accordance with the Health Professions Act (HPA), Health Professions and Occupations Act (HPOA), the Freedom of Information and Privacy Protection Act (FOIPPA), the Privacy Act, the Personal Information Protection and Electronic Documents Act (PIPEDA), College bylaws, and administrative law. The CLC is responsible for delivering high quality legal and strategic advice to the BC College of Nurses and Midwives\xe2\x80\x99 (BCCNM) Board, Registrar/CEO, committees, and staff, as appropriate, on bylaws, policies, processes, and discrete files. The CLC also fulfills the role of Privacy Advisor, Legal, in the College\xe2\x80\x99s Privacy Office, monitoring legislative changes and assisting with assessing risk related to privacy. \xe2\x80\x8bKey responsibilities include:
  • In consultation with the CO, SG&R, contributes to strategic and operational plans, identifying key priorities related to their Legal Counsel role and aligned with the priorities of the College.
  • In consultation with the CO, SG&R, and through cultivating a deep understanding of the business, strives to continuously advance the work of the regulator through the strategic assessment of practices, bylaws, and approaches, and by providing proactive, solution-oriented advice.
  • Works to ensure BCCNM is legally consistent and striving to meet the objectives of the UN Declaration on the Rights of Indigenous Peoples as well as BC\xe2\x80\x99s Declaration on the Right of Indigenous Peoples Act.
  • Provides and/or facilitates with external Legal Counsel support, legal analysis and advice of College policy and programs as needed; drafts, and recommends changes to College bylaws and internal policies and procedures to ensure the ongoing efficient and effective management of the College, and to ensure best practice and compliance with administrative law.
  • Provides timely, pro-active and solution-oriented legal and strategic advice to the CO, SG&R, the Registrar/CEO, Leadership Team, and Board regarding changes to bylaws, policies and processes, and the Health Professions Act.
  • Provides a strategic analysis of all legal risks to BCCNM and provides support as needed to regulatory program areas such as inquiry, discipline and monitoring and registration.
  • Leads the development of BCCNM bylaws and changes to bylaws; collaborates with staff and leaders to guide governance and operations bylaw changes; ensures clear consultative process; creates bylaw amendment cycle; determines priority setting; liaises with other regulators regarding bylaw development and amendments.
  • Facilitates BCCNM\xe2\x80\x99s implementation of the new HPOA including ensuring BCCNM is compliant with the HPOA when enforced. Provides analysis and insight into the functionality of legislation and work collaboratively with other health regulatory colleges and the Ministry of Health on roll-out and implementation.
Your education & skills \xe2\x80\x8b
  • Bachelor of Law Degree or Juris Doctor required. Must be a practicing member of the Law Society of B.C.
  • Seven to ten years\xe2\x80\x99 experience in a regulatory setting or working in the area of administrative law. Experience in professional regulatory law is an asset.
  • Thorough knowledge of existing legislation such as Health Professions Act (HPA), Health Professions and Occupations Act (HPOA), the Freedom of Information and Privacy Protection Act (FOIPPA), the Privacy Act, the Personal Information Protection and Electronic Documents Act (PIPEDA), College bylaws, and administrative law and other statutes that impact the organization\xe2\x80\x99s operations.
  • Excellent oral, written and interpersonal communication skills. Ability to provide legal advice in a pragmatic and risk-based manner.
  • Demonstrated experience successfully providing counsel to all levels within the organization, clearly and concisely communicated in an effective manner to non-legal minded leaders and staff.
  • Thorough knowledge and practice experience in corporate law, including intellectual property, strategic contract negotiations and corporate communications.
  • Expert ability to analyze, research, evaluate and interpret legal issues.
  • Superior organizational skills, experience in managing a high volume of work and large caseload, and the ability to handle diverse situations as they arise.
  • Ability to work effectively under continual deadlines with limited resources.
  • Ability to work within several statutory frameworks and apply relevant legal principles to diverse issues.
  • Ability to exercise good judgment in recognizing scope of authority and protecting confidential information.
  • Ability to establish and maintain professional relationships with registrants, stakeholders, and the public.
  • Ability to work independently and collaboratively within a team environment.
  • Intermediate to advanced skills with current MS Office systems is required.
  • Experience with MS CRM Dynamics and MS SharePoint an asset.
  • Designation as a Certified Information Privacy Professional \xe2\x80\x93 Canada (CIPP/C), or similar designation an asset.
  • Recent work experience in administrative law and in professional regulation specifically, preferred.
  • Demonstrated understanding of diversity, inclusion, and cultural humility as they apply to legal frameworks, corporate entities, and nursing and midwifery practice in health care is an asset.
  • Experience with volunteer or elected boards an asset.
