What Is The Opportunity
Aecon is proactively seeking a Prime Contracts Lead to join the Urban Transportations Solutions group to support future dynamic, transit projects in Canada. What You Will Do Here:
In the bid phase, review the Prime Contract to determine and advise the Bid Team on the obligations, liabilities and potential risk.
Lead the formation of agreements from a commercial perspective with design services firms and suppliers during the in-market phase.
Participate in Bid negotiations as appropriate.
Advise Estimating on Contract Management resource needs to be included in the bid price.
Develop the Prime Contract Variation Management Plan, identifying appropriate change / claim management processes, resource needs, templates and deliverables.
Work closely with the legal team and subcontracts manager to ensure flow down of the prime contract terms to other related contracts on the project.
Manage the commercial aspects of the prime contract including change management, compliance with prime contract obligations and deliverable deadlines, reporting and dispute resolution.
Proactively coordinate with subcontracts, cost and construction teams to obtain quotations for variations.
Work closely with the Project Director or Project Manager throughout the construction of the project and recommend appropriate solutions and draft correspondence as appropriate.
Assist the project team with developing terms and conditions for subcontract templates ensuring appropriate flowdowns of prime contract terms and conditions - such as upstream notification timelines, insurance requirements, etc.
Advise on opportunities for revenue savings, risk mitigation and claim avoidance.
Work closely with engineering, construction, procurement and project controls to understand project activities and any impact of those activities to the prime contract.
Review cost and schedule variances to understand whether issues need to be notified to the Owner and adjustments made for time and cost under the contract.
Track contract changes/modifications and ensure appropriate documentation / records are being kept to support such issues.
Prepare any change orders, variations, claims, counter claims, delay claims to the contract and assist with negotiation / resolution.
Manage the dispute process of any issues under the Prime Contract.
Coordinate close out processes relating to the Prime Contract.
Consultation with Legal and Project / Project Management team / Subject Matter Experts / External Consultants as appropriate.
Work with the Risk Management and Insurance teams on any issues that may be related to insurance policies.
Ensure timely and accurate contractual correspondence.
Maintain excellent relationships with the owner, client, project team, subcontractors and the community.
What You Bring To The Team:
Minimum undergraduate degree in a related discipline such as engineering.
A minimum of 10 years of experience in contract management, project management, claims management, bid management, project controls and/ or contract law.
Sound understanding of the construction processes and work methodologies.
Advanced knowledge and understanding of the different contract types such as cost reimbursable, lump sum, unit price, target price, and design build.
Excellent communication skills, both verbal and written. Proven ability to distill down complicated concepts and/or situations to its core elements.
Experience in dispute resolution processes.
Proven negotiation skills.
Experience with design build projects including the management of design change issues in a prime contract / change management role.
Demonstrated track record of successfully negotiating with various internal and external stakeholders.
Experience in communicating with various stakeholder groups from internal project staff to clients, subcontractors, executive team and joint venture partners.
Experience with integrated ERP systems.
