We are currently seeking a Law Clerk to join our Toronto office to provide support to the Real Estate Practice Group. Dealing with:
Title searches, from onset to completion, plotting out all legal descriptions using metes and bounds perimeters where necessary, preparation of title summaries and reporting to assigning paraprofessional and/or solicitor;
Problem-solving of title problems;
Conducting subsearches for various purposes, memorandums to assigning paraprofessional and/or solicitor;
Preparation of various name change applications and/or notices of lease, coordinating with the client for execution of same and attending to registration of the documents and reporting to the client;
Responsible for docketable target hours and reporting to accounting.
Key Responsibilities: Conducting, Researching and Analyzing
Conducting full title searches of properties, including lands in Land Titles Absolute, Land Titles Absolute Plus, Land Titles Conversion Qualified and in the Registry System
Ability to plot and decipher metes and bounds descriptions and ability to determine boundary discrepancies
Analyzing all details and using surveys and reference plans to confirm boundaries where applicable
Researching and Analyzing the Planning Act (Ontario) and knowing all relevant dates for purposes of conducting all abutting land searches
Conducting other title queries/ subsearches and analyzing details
Reviewing, Preparing, Assembling and Drafting
Reviewing all title search details, including all parcel registers, abstract and parcel pages, executions, instruments, including easements, all abutting lands, corporate owners and existence, legal access and obtaining and reviewing the crown patent and crown survey, where applicable
Preparing Title Summaries using our firm standard title summary to evidence all details of the title search, including colour coding plans/ surveys/reference plans to lands, abutting lands and easements
Reviewing other subsearch and title query results and preparing summary of results to paraprofessional and lawyer
Drafting EREG documents in Teraview where applicable including but not limited to Notices of Lease and/or Name Change Applications
Co-ordinating with client and attending to registration of various EREG instruments when requested
Liaising and Communication
Consults and collaborates with paraprofessionals, solicitors and clients to receive and implement instructions at onset and during the course of the work assignment
Negotiate, communicate and consult with paraprofessional and solicitor as well as any staff with OnLand and/or the Land Registry Office in accordance with delegated responsibility provided by the paraprofessional and/or solicitor in charge
Flagging and anticipating potential title issues and communicating these issues to the attention of the paraprofessional and solicitor reviewing the title search and summary
Problem solving with respect to all title searches and subsearches
Collaborate with support staff and supervise assistant(s)
Research
Research and interpret legal and technical procedures, statues and regulations applicable to title and registration of documents
What you\'ll bring:
Law Clerk Diploma; potentially also an Undergraduate degree (preferred);
2-5 years\xe2\x80\x99 experience or higher;
Title searching in a law firm or as a freelance agent;
Excellent written and verbal communication as well as excellent organizational and analytical skills;
Solid foundation of title searching ability, good drafting and mathematical skills are also required;
Continuing education to keep abreast of changes;
Proficient in using Teraview, Onland, word processing using Microsoft Word, Excel, Adobe, Outlook and iManage;
Proficient in legal-related accounting programs (Aderant preferred).
