Investigative Counsel

Enforcement

Are you a lawyer who enjoys investigating as much as legal research? Can you provide legal advice on challenging securities issues and investigate complex fraud cases? Are you ready to testify instead of examine? The Enforcement Division of the British Columbia Securities Commission is hiring an investigative counsel in the Investigations Branch.

In this role, you\xe2\x80\x99ll be investigating fraud, insider trading, crypto currency schemes and other potential breaches of the securities legislation. You will use your analytical skills to piece together complex evidence to be used in Commission hearings, and use your legal skills to negotiate settlements and provide legal advice. You\xe2\x80\x99ll work closely with other investigators and other agencies and regulators, including at an international level.

As Investigative Counsel, you will report to the Manager, Investigations who supervises case teams. Your key responsibilities will include:

  • Providing legal advice to professional staff investigating breaches of securities laws
  • Working with investigators and forensic accountants to investigate potential breaches of the Securities Act
  • Reviewing the scope of investigation orders
  • Developing and implementing investigative plans and adhering to timelines
  • Participating in or conducting witness interviews
  • Identifying and resolving potential issues related to the evidence
  • Brainstorming opportunities to apply the Securities Act
  • Recommending allegations with evidence briefs that support your recommendations
  • Negotiating settlements
  • Drafting legal documents such as settlement agreements, written submissions and affidavits
  • Applying for preservation orders and temporary orders
  • Handling applications to vary or revoke preservation orders and temporary orders
  • Coordinating information sharing and cooperation with securities regulators in other jurisdictions
  • Staying up to date on industry trends, legislation changes and policy developments in other jurisdictions
Qualifications

The ideal candidate has:
  • LL.B or J.D. and membership in the Law Society of British Columbia (or eligibility for membership)
  • Litigation experience
  • Knowledge and experience in the area of securities law, as well as regulatory and administrative law
  • Experience conducting comprehensive legal research
  • Demonstrated analytical skills with an ability to think creatively and strategically in exercising sound professional judgment to determine appropriate solutions
  • Excellent interpersonal and communication skills
Other assets include:
  • Securities experience
  • Completion of the Canadian Securities Course
  • Experience conducting investigations

Salary Range:

The salary range for Investigative Counsel (generally up to 10 years of legal counsel experience) is $113,444 (minimum) - $151,014 (midpoint) - $188,585 (maximum).

The starting salary for this position will be determined considering the successful candidate\xe2\x80\x99s relevant experience and education, salaries of other employees in the same salary range, market conditions and other relevant factors. Starting salaries are normally below the salary band midpoint.
