The Opportunity





As the Town's Hearing Officer, appointed by Council you will review administrative penalties as per Ontario Regulation 333/07 and penalty orders as per Ontario Regulation 355/22, you will review decisions made by Screening Officers in relation to Town's Administrative Monetary Penalty System (AMPS). You must be familiar with municipal law and adjudicative processes, as you will be responsible for determining whether to affirm, vary or cancel (on a review or an appeal) the penalty decisions made by Screening Officers.



All decisions made by Hearing Officers are deemed final and binding, and hearings may be conducted in person, virtually or in writing.



As the Hearing Officer you will perform the following duties, including but not limited to:


Conduct in-person and online reviews/appeals in a tribunal setting under the Administrative Monetary Penalty System (AMPS) from start to finish. Interpret and apply legislation, regulations, and policies with consideration for potential systemic impacts on marginalized communities. Educate and inform the public about Town of Caledon by-laws, policies, and AMPS processes using inclusive communication strategies.



Hearing Officer Qualifications:



Post-secondary degree in Law, Legal Studies, Political Studies, Public Policy or closely related field. Minimum five (5) years' experience in law enforcement, judiciary processes, policy interpretation, or equivalent, working experience with or in a regulatory environment with diverse populations. Formal training and experience in alternative dispute resolution. Membership in The Society of Ontario Adjudicators and Regulators (SOAR) or The Law Society of Ontario is preferred. Certificate in Adjudication for Administrative Agencies, Boards & Tribunals is preferred. Knowledge and experience in interpreting and applying the Municipal Act, 2001, Highway Traffic Act, Statutory Powers Procedure Act, applicable municipal by-laws, court adjudication settings municipal and provincial regulations. Exceptional investigative/research, analytical/problem solving, adjudication and mediation, and effective resolution, organizational and time management skills to prioritize tasks in high-pressure environments. Strong oral and written skills regarding legal documentation; report writing, attention to detail and accuracy are required. Experience using MS Office (Word, Excel, Outlook), including virtual conferencing technology, and spreadsheet application, along with knowledge of relevant case management software. Knowledge of Gtechna is an asset.



Eligibility




Must Satisfy the eligibility criteria outlined in Section 3.4 of the Screening and Hearing Officers by-law Members of Council, employees of the Town of Caledon, the child, parent or spouse of a Member of Caledon Council or employee of the Town and persons indebted to the Town are not eligible to apply.



Compensation





This position offers a per diem as per the following:



$300 for half day



$600 for full day



Please note that a half-hour lunch break is unpaid.





The successful candidate for Hearing Officer will be required to work a flexible schedule, including in the office, remote and after hours (as required).
