Position Overview
As an Enforcement Officer you will enforce the Smoke-Free Ontario Act, the Electronic Cigarettes Act, the By-Law to Regulate Smoking in Public Places and Workplaces, and the Standing Water By-Law. You will conduct inspections and investigations activities including Ministry mandatory site visits, complaints, education, surveillance, and ticketing activities.

Enforcement includes inspecting schools, tobacco retailers, vaporizer retailers, businesses, workplaces, public spaces, and outdoor spaces; issue Provincial Offence Notices (lay and process charges when infractions occur).
Duties and Responsibilities

Enforcement Activities:

  • Act as Enforcement Officer to enforce the Smoke-Free Ontario Act, and Electronic Cigarettes Act by inspecting schools, tobacco retailers, workplaces, public spaces and outdoor spaces for compliance with the Acts; issue Provincial Offences Notices (lay and process charges when infractions occur)
  • Conduct compliance activities and co-ordinate with test shoppers to ensure tobacco and e-cigarette retailers comply with the Smoke-Free Ontario Act and the Electronic Cigarettes Act
  • Prepare all legal documents for enforcement proceedings under the Provincial Offences Act related to Smoke-Free Ontario Act, the Electronic Cigarettes Act, the County of Lambton By-Law 26 of 2003, and By-Law 10 of 2004
  • Record enforcement activities on applicable forms
Inspections:
  • Conduct inspection activities in accordance with the By-Law to Regulate Smoking in Public Places and Workplaces, the Smoke-Free Ontario Act, and the Electronic Cigarettes Act including education, surveillance, and ticketing activities
  • Conduct complaint inspections under The Corporation of the County of Lambton By-Law 26 of 2003 (to regulate standing water) and By-Law 10 of 2004 (to regulate Smoking in Public Places and Workplaces), the Smoke-Free Ontario Act and the Electronic Cigarettes Act.
  • Collect evidence
  • Produce monthly reports and summaries of inspection activities
Court Proceedings:
  • Serve as a witness for establishments who are charged for non-compliance
  • Collecting evidence \xe2\x80\x93 compiling court documentation, laying of appropriate charges, preparing court briefs and attending court as required
General:
  • Incumbents must keep up-to-date on all relevant legislation, collective bargaining agreements, County Policies and Procedures, etc. ensuring that these are implemented as prescribed
  • Incumbents must possess the physical ability to meet the duties and responsibilities of the job description and/or the requirements identified within the position\'s Physical Demands Analysis

Qualifications

Minimum Formal Education:
  • Post-Secondary education in Law such as Protection, Security and Investigation or Police Foundations and/or related experience in Law Enforcement
Experience:
  • Two years of experience
  • Knowledge of court procedures
  • Police or enforcement training
A valid Ontario driver\xe2\x80\x99s license and use of a vehicle.
