The Head Office is located in Halifax and there are regional offices throughout the province.The core functions of the Nova Scotia Public Prosecution Service are to:

  • Represent the Crown in the conduct of criminal trials and criminal appeals before all levels of courts
  • Participate in the development of criminal law and criminal prosecutions policy
  • Provide advice to police in respect of prosecutions generally or in respect of particular investigations
  • After a charge is laid by police a Crown Attorney will review the evidence and determine if there is a realistic prospect of conviction
  • The Crown Attorney will also consider the public interest to determine if a charge should proceed even if there is a realistic prospect of conviction
For more information on the Public Prosecution Service please visit the following link:About Our OpportunityThe position of Crown Attorney, Appeals and Special Prosecution Section, is located in the Nova Centre offices of the Public Prosecution Service, in Halifax.As the Crown Attorney, Appeals, your duties include, but are not limited to:
  • Preparation and argument of criminal appeals before the Nova Scotia Court of Appeal and other provincial appellate courts in cases where the local provincial Crowns are conflicted from having carriage of the matter under appeal
  • Applications for leave to appeal and appeals to the Supreme Court of Canada
  • Legal opinions on recommendations for appeal
  • Attendance at section meetings
  • Providing advice to trial Crown Attorneys regarding jury charges, evidentiary issues, Canadian Charter of Rights and Freedoms issues, constitutionality of legislation, and various other issues
  • Preparation for and attendance in Court of Appeal Chambers on a variety of contested and uncontested motions
  • There may be times that you will be required to conduct criminal trials, particularly if they involve complex legal issues
Primary AccountabilitiesThe Crown Attorney (Appeals), Appeals and Special Prosecutions, reports to the Chief Crown Attorney, Appeals and Special Prosecutions and is responsible for preparation and argument of criminal appeals before the Nova Scotia Court of Appeal and appeals to the Supreme Court of Canada, legal opinions on recommendations for appeal, attendance at section meetings, providing advice to trial Crown Attorneys, and preparation for and attendance in Court of Appeal Chambers on a variety of contested and uncontested motions.As well, operational requirements may involve handling trials where necessary and where the appeals schedule allows.Qualifications and ExperienceYou will be a practicing member of the Nova Scotia Barristers\' Society with a thorough understanding of the prosecution process and competence in the areas of criminal procedure, evidence and substantive criminal law, particularly as it relates to criminal appeals practice. You will have at least two years experience in Public Prosecutions. The applicant must possess significant experience in criminal trial courts, demonstrated skills in research and analysis, legal writing and oral argument; and thorough knowledge of the appeals provisions of the Criminal Code and Nova Scotia Civil Procedure Rules. Recent and extensive experience in summary conviction appeals and experience with constitutional challenges to legislation are required; and recent experience in the Nova Scotia Court of Appeal in criminal appeals would be considered an asset.
