REPORTS TO: County Solicitor & Corporate Counsel
LOCATION: Burford Administration Office \xe2\x80\x93 Initial PlacementMinimum Qualifications:

  • A Paralegal (P1) License with the Law Society of Ontario or equivalent.
  • A minimum of 7 years\xe2\x80\x99 experience in Ontario providing services on behalf of a municipality or other level of government, or with a private law firm serving mainly municipal clients, with an emphasis on prosecutions before the Ontario Court of Justice, litigation before the Ontario Small Claims Court (SCJ) and further general litigation experience before a range of different regulatory bodies and/or administrative tribunals.
  • Thorough knowledge of Provincial Offences Act, Charter of Rights and Freedoms, Ontario Human Rights Code, Statutory Powers and Procedures Act, as well as Municipal Act, Municipal Freedom of Information and Protection of Privacy Act and Planning Act.
  • In-depth and hands-on knowledge of policies, practices and court procedures related to the prosecution of provincial offences.
  • Demonstrated understanding of the role and function of the prosecutor in trial and appeals
  • A strong and confident working knowledge of current federal and provincial statutes, rulings, regulations, orders and decisions by provincial and federal courts and tribunals, as they impact municipal government
  • A dedication to providing a high level of public service. The ability to deal courteously and effectively with all levels of staff and government, elected officials, local Boards/Commissions, community groups and organizations, the general public and the legal and insurance communities.
  • Excellent administrative, research, problem solving, communication, negotiation, presentation, analytical, writing, legal drafting, and organizational skills. Must be able to effectively handle highly confidential information in an appropriate manner, in order to protect the interests of the County of Brant
  • Superior interpersonal skills, and be able to communicate clearly and effectively (both orally and in writing), with members of Council, staff, external agencies, and other interested parties
  • Highly developed strategic, creative, critical thinking, conflict resolution, and conceptual abilities, and the demonstrated skill to work effectively in a collaborative environment by contributing to the overall goals of the County
  • Ability to work independently under tight timelines, with ability to adjust priorities in a dynamic and demanding environment, with a strong emphasis on providing a high level of trustworthy customer service to internal departmental clients
  • Demonstrated safe work practices
  • Valid class \xe2\x80\x9cG\xe2\x80\x9d driver\xe2\x80\x99s licence and vehicle to use on municipal business, and a clean criminal records check
Assets:
  • Experience with real estate and contract law, especially the ability to assist with municipal real estate matters, such as registration of documents, conducting searches, assisting with the conveyance of lands or interests in lands, administering sale of municipal lands where authorized, and general real estate matters
Duties:
  • Provide assistance, coordination, implementation, and administration in support of the goals, policies, procedures, services and programs of the Municipality, in accordance with Council policy, all applicable law, and statutory obligations in a cost-efficient and effective manner
  • Primarily conduct prosecutions from initiation to disposition (inclusive of potential appeals) under the Provincial Offences Act for charges laid pursuant to Provincial legislation and County of Brant By-Laws, including conducting early resolution meetings, presenting arguments, preparing witnesses, and anticipating defence positions, while maintaining ethical standards and fairness.
  • Research and prepare oral and or written arguments (factums); collect and evaluate evidence; interpret and apply statutes and precedence; decide whether or not to proceed as per prosecutorial discretion.
  • Conduct appeals in the Ontario Court of Justice.
  • Meet with law enforcement officers and provide direction with respect to provincial offence matters.
  • Perform related administrative functions including providing disclosure, drafting correspondence, reviewing and processing files, and managing trial lists.
  • Represent the County of Brant before the lower courts and tribunals, including Small Claims Court, the Licensing Appeal Tribunal (County) and the Ontario Human Rights Tribunal.
  • Prepare reports and memoranda to the Solicitor and Corporate Counsel and Assistant County Counsel, as well as departmental staff, concerning the effect and impact of relevant legislation and policy changes or as directed
  • Conduct legal research on a variety of legal issues leading to the preparation of legal opinions, reports and papers summarizing results including recommendations respecting implementation, form or response or course of action to be taken
  • Undertake special projects and perform other duties as assigned in accordance with departmental and corporate objectives
