Job Description


The Compliance Officer II is responsible to investigate, inspect and audits external stakeholders to determine compliance with The Workers Compensation Act; and if non-compliance is established to take action to mitigate the effects of the contravention; encourage future compliance and/or impose administrative sanctions.

Job Duties:

Performs administrative investigations, audits and inspections related to worker and health care provider claim abuse, premium abuse, and interference with workers\' rights.

Uncovers and collects all available physical and electronic evidence relevant to the case; exercises the authority of an Inspector under section 99 of The Workers Compensation Act to compel production of records or inspect a premises; stores and logs evidence in accordance with policy.

Identifies possible independent witnesses and secures their cooperation to provide recorded statements to support an investigation, audit or inspection; prepares a detailed interview plan and safety assessment before scheduling or conducting interview; interviews complainants, informants, independent witnesses and the subject(s) of the investigation either on site or off-site; and ensures there is accurate transcript or recording of the interview.

Follows procedural fairness requirements and privacy laws.

Evaluates the relevance, sufficiency, quality, veracity and integrity of all evidence collected to determine if a contravention of The Workers Compensation Act can be established.

Considers any mitigating or aggravating factors when determining the appropriate sanction(s) for non-compliance.

Communicates case finding(s) in comprehensive written reports; where appropriate, provides recommendations on changes to processes, practices and policies to support future compliance.

Issues orders to compel production of documents, posting of notices, and/or payment of administrative penalties.

Performs other related duties as assigned.

Qualifications:

University degree in Law, Political Science, Psychology, Sociology, Criminal Justice, Public Administration, Accounting or a related discipline

Minimum of three (3) years\' experience performing administrative investigations, external financial audits, or program evaluations for which comprehensive written reports are produced/issued

Knowledge of the principles of administrative law and statutory interpretation

Knowledge of accounting principles, particularly in regard to payroll accounting practices

Proficiency in the use of personal computers and software (Word, Excel and PowerPoint) in a Windows environment

Proficiency in the use of business applications related to investigations

Well-developed research, analytical, decision making and problem solving to resolve complex problems

Strong documentation and case/project management skills

Ability to communicate effectively, both verbally and in writing, including expertise in drafting administrative decisions and recommendations

Excellent stakeholder interviewing skills

Advanced internet-based investigation skills

Ability to deal tactfully, diplomatically and objectively with internal and external stakeholders in confrontational situations

Strong interpersonal skills with the ability to encourage collaboration with diverse groups

Superior persuasion skills with the ability to convince diverse parties to cooperate/participate in an investigation

Ability to organize and prioritize work load while managing multiple demands

Ability to work independently and as part of a team

Ability to travel in Manitoba

Ability to obtain and maintain a level of security clearance required for this job

Interviewing skills using the PEACE model would be an asset
