We are looking for a Bilingual (French and English) Law Clerk.
You will work in partnership with a dedicated team of litigation counsel and law clerks to deliver effective and efficient legal services for cases across Canada. You will be involved in defence files related to a wide variety of issues affecting the organization, including complex claims, short term and long term disability, investment-related matters and other issues. Applying your education, practice experience and business knowledge, you will add value by providing key law clerk services and supporting all aspects of the litigation practice. You will help drive continuous process improvement and innovation within the litigation team.
What you will do:
Preparing and drafting of correspondence and legal documents (Statements of Defence, Motion Records, Affidavit of Documents, Affidavits, Pre-Trial/mediation briefs, Releases, Discontinuances, Minutes of Settlement, Dismissal Orders); ensuring all appropriate documents and forms are filed properly according to the applicable jurisdiction and other materials on behalf of counsel
Supporting Counsel in all aspects of case development, including reviewing, summarizing, and analyzing initiating documents and file materials, managing production documents - monitoring incoming, pursuing outstanding requests
Liaising between counsel, external parties, and claims personnel as required to move matters forward proactively
Preparing Examinations for Discoveries (Managing next steps, arranging dates, serving Notices, preparing electronic productions, and managing undertakings)
Arranging independent medical examinations and preparing all related documentation
Arranging surveillance and other investigations and preparing all related documentation, liaising with investigator and reporting to client and counsel
Arranging mediations and preparing all related documentation, including draft mediation brief
Reviewing and triaging incoming legal documentation
Ensuring all relevant documents are properly stored in the Law Department's Document Management Systems (M-Files), and are named and classified in accordance with Litigation practice guidelines
Entering all relevant data in Law Department's matter management system (eCounsel)
Taking initiative in determining next steps in respect of litigation files
Other duties as required
What you will bring:
Post-secondary diploma in a recognized law clerk program, or combination of education and experience.
Minimum 5 years' experience in an insurance defence environment with a thorough understanding of the relevant rules of court and legal terminology.
Bilingualism (fluent in French and English) required, as the position will regularly serve our clients with English and French-speaking needs.
Knowledge of legal and court documents and procedures across Canada.
Ability to work as part of a team and also to independently manage own workload, with well-developed organizational and time management skills, and to handle changing and competing priorities.
Motivated self-starter with ability to work productively under pressure and deliver business results.
Superior communication skills, both written and verbal, including proofreading with keen attention to detail and the ability to draft substantive written communications and court materials (pleadings, briefs, and other correspondence).
Ability to communicate effectively with various counsel, clients, investigators, court and medical personnel.
Strong technical skills (MS Word, Excel, Outlook, Adobe Pro, matter management and document management software).
Excellent interpersonal and client services skills; professional and positive demeanour.
Experience working with highly sensitive and confidential information as part of daily duties.
This position is hybrid work style requiring a minimum three days in office. Given the size and scope of our organization, we have the flexibility for this position to be located in the following head office locations: Montreal, Toronto, London, Winnipeg.
